Who follows this notice
This notice applies to Alabaster Integrative Health & Wellness and Alabaster Beauty & Wellness, including our medical, telemedicine, hormone, aesthetic, IV therapy, and massage services, and to everyone who works with us in caring for you: our supervising physician (Joe C. Hubbard, MD), nurse practitioners, nurses, licensed massage therapists, staff, contractors, and volunteers. All of them follow the terms of this notice and may share information with each other for treatment, payment, and health care operations as described below.
Our commitment to your privacy
Your health information is personal, and we take protecting it seriously. “Protected health information” (PHI) means information that identifies you and relates to your past, present, or future physical or mental health, the care you receive, or payment for that care. This includes your intake forms, treatment notes, lab results, prescriptions, photographs taken for your care (such as before-and-after aesthetic photos), and billing records.
Our duties to you
By law, we must:
- Keep your protected health information private and secure.
- Give you this notice of our legal duties and privacy practices.
- Follow the terms of the notice currently in effect.
- Notify you promptly if a breach occurs that may have compromised the privacy or security of your information.
- Not use or share your information other than as described here unless you tell us we can in writing. If you give us permission, you may change your mind at any time by telling us in writing.
How we may use and share your health information
Treatment
We use and share your information to provide, coordinate, and manage your care. For example, our nurse practitioner may review your labs before recommending hormone therapy, consult with our supervising physician, send a prescription to a pharmacy (including a compounding pharmacy), order lab tests, or share information with another provider who is treating you. Your massage therapist may review relevant health history to make sure massage is safe for you.
Payment
We use and share your information to bill and get paid for the services we provide. For example, we may share information with your health plan or a payment processor, or provide a receipt or superbill you can submit for reimbursement.
Health care operations
We use and share your information to run our practice, improve care, and contact you when needed. For example, we may use information to review the quality of our care, train staff, conduct audits, handle licensing and accreditation, and manage our business.
Business associates
We work with outside companies that perform services for us, such as electronic health record and telemedicine platforms, scheduling and reminder systems, laboratories, billing services, IT support, and secure file storage. These companies must sign an agreement promising to protect your information and to use it only as we allow.
Telemedicine
When you receive care by video or phone, we use secure platforms intended for health care. We ask that you join from a private location. Information shared during a telemedicine visit is protected the same way as an in-person visit.
Appointment reminders and health-related communications
We may contact you by phone, text, or email to remind you of appointments, follow up after treatment, or tell you about treatment options or health-related services we offer. You may ask us to contact you a different way or at a different place (see “Your rights” below). Standard text messages and email may not be fully secure; tell us if you prefer we not use them.
People involved in your care or payment
With your agreement, or if you do not object when given the chance, we may share information with a family member, friend, or other person you identify who is involved in your care or helps pay for it. If you are not present or are unable to agree (for example, in an emergency), we may share information if we believe it is in your best interest, limited to what is relevant to that person’s involvement.
Other uses and disclosures allowed or required by law
We may use or share your information without your written authorization in the following situations, as permitted or required by federal and Texas law:
- As required by law: when federal, state, or local law requires it.
- Public health and safety: to prevent or control disease, report adverse reactions to medications or products (including to the FDA), report suspected abuse, neglect, or domestic violence, or help prevent a serious threat to someone’s health or safety.
- Health oversight: to agencies such as the Texas Medical Board, Texas Board of Nursing, Texas Department of Licensing and Regulation, and other agencies for audits, investigations, inspections, and licensure.
- Lawsuits and legal actions: in response to a court or administrative order, or a subpoena, subject to the protections the law requires.
- Law enforcement: for certain law enforcement purposes, such as responding to a valid court order or warrant, or reporting certain injuries as required by law.
- Coroners, medical examiners, and funeral directors: as needed for them to carry out their duties.
- Organ and tissue donation: to organizations that handle organ, eye, or tissue donation.
- Research: under limited conditions that protect your privacy, as allowed by law.
- Workers’ compensation: for workers’ compensation or similar programs, as allowed by law.
- Specialized government functions: for military, national security, or protective services, as allowed by law.
- Correctional institutions: if you are an inmate or in custody, as allowed by law.
Uses and disclosures that require your written permission
We will not do the following without your written authorization:
- Marketing: use or share your information for marketing purposes (other than face-to-face communications or small promotional gifts as the law allows).
- Sale of information: sell your health information. We do not sell patient information.
- Photos and testimonials: use your photographs (including before-and-after photos), name, story, or testimonial on our website, social media, or advertising.
- Psychotherapy notes: share psychotherapy notes, if any exist, except in limited cases the law allows.
- Any other use not described in this notice.
You may revoke an authorization at any time in writing, except to the extent we have already acted on it.
Specially protected information
Some types of information have extra protection under federal or Texas law, for example HIV/AIDS test results, genetic information, certain mental health records, and substance use disorder treatment records covered by 42 CFR Part 2. When those laws are stricter than HIPAA, we follow the stricter law. We will not use substance use disorder treatment records received from a Part 2 program in civil, criminal, administrative, or legislative proceedings against you without your written consent or a court order, as the law requires.
Texas law
Texas law (Texas Health and Safety Code Chapter 181) adds protections for your health information. We will not disclose your information electronically except as permitted by law, and we will not sell your information. Where Texas law requires your consent or authorization for a disclosure, we will obtain it.
Your rights
You have the following rights regarding your health information. To use any of them, contact our Privacy Officer at (254) 335-0046, by email at jschulz@alabastermed.org, or in writing at the address above.
Get a copy of your records
You may ask to see or get a copy of your medical and billing records, in paper or electronic form. We will respond within 30 days, and for records we keep electronically, Texas law asks us to provide them within 15 business days of a written request. We may charge a reasonable, cost-based fee as the law allows.
Ask us to correct your records
You may ask us to correct health information you believe is incorrect or incomplete. We may say “no,” but we will tell you why in writing within 60 days, and you may submit a statement of disagreement.
Request confidential communications
You may ask us to contact you a specific way (for example, a cell phone instead of a home phone) or at a different address. We will agree to all reasonable requests.
Ask us to limit what we use or share
You may ask us not to use or share certain information for treatment, payment, or operations. We are not required to agree, and we may say no if it would affect your care. If you pay for a service or item out of pocket in full, you may ask us not to share that information with your health insurer for payment or operations, and we will agree unless the law requires us to share it.
Get a list of those with whom we’ve shared information
You may ask for a list (an “accounting”) of the times we’ve shared your information in the six years before your request, who we shared it with, and why. This list will not include disclosures for treatment, payment, or operations, or certain others (such as those you asked us to make). We will provide one list a year for free and may charge a reasonable, cost-based fee for additional requests within 12 months.
Get a copy of this notice
You may ask for a paper copy of this notice at any time, even if you agreed to receive it electronically. It is also posted in our office and on this website.
Choose someone to act for you
If you have given someone medical power of attorney, or if someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will confirm the person has this authority before we act.
Be notified of a breach
You have the right to be notified if your unsecured health information is breached.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us or with the federal government. We will not retaliate against you for filing a complaint.
